Why Sports Betting Is Profitable
May 2021, Governor Ralph Hogan signed enabling legislation into law, green-lighting sports betting to go live in late 2021. On November 3, 2020, voters in South Dakota approved a ballot measure permitting “sports wagering in Deadwood.” Other tribal locations in South Dakota could see the arrival of regulated sports betting too. State lawmakers must now establish a regulatory apparatus and tax rate for legalized sports wagering. Sports betting launched Sept. 9, 2021 and is allowed on-site at casino properties in Deadwood.

Under federal law, the Wire Wager Act prohibits transmitting information involving wagering on any sporting event, except in states where such bets are legal. PASPA precludes bets on the performance of professional athletes or the games they play, unless such betting activity was legal in a state at the time of passage. Thus, if indeed fantasy contests are truly wagering contests, then both principal federal statutes appear to prohibit fantasy games, unless specifically permitted under state law.
